PUBLIC BUSINESS FROM THE FLOOR - AGENDIZED ITEMS

Any person who would like to address the City Council, Successor Agency, and Power/Financing/Housing Authorities on any agendized item is requested to complete a speaker card for the City Clerk/Agency/Authority Secretary and identify the agenda item you would like to discuss. Each person will be given an opportunity to address the Legislative Body at the time such item is discussed. Speaker cards are available at the rear of the Council Chambers and your speaker card must be filled out prior to the agenda item being called. We respectfully request that you fill the cards out completely and print as clearly as possible. Following this procedure will allow for a smooth and timely process for the meeting and we appreciate your cooperation. Individual speakers are limited to three (3) minutes each.

Consent Calendar items under the Legislative Body may be acted upon with one motion, a second and the vote. If you desire to speak on an item or items on the Consent Calendar, you may fill out one speaker card for the Consent Calendar. SA NB 1. Recognized Obligation Payment Schedule for the period July 1, 2013 to December 31, 2013

Recommendation:

Adopt Resolution No. SA 02-13, approving the Recognized Obligation Payment Schedule for the period July 1 to December 31, 2013 and directing staff to bring before the Lancaster Successor Agency Oversight Board for approval.

Health & Safety Code Section 34177(m) requires the Successor Agencies of the previous redevelopment agencies to prepare Recognized Obligation Payment Schedules (ROPS) that list obligations to be paid for the coming six month period. These schedules are used by the County Auditor-Controller in determining the amount of property tax revenues to distribute to the Successor Agency.

Recommendation:

Adopt Resolution No. SA 03-13, approving the Successor Agency Administrative Budget for the period of July 1 to December 31, 2013 as detailed in Attachment A of the staff report.

Health & Safety Code Section 34177(j) requires the successor agencies to adopt six month budgets. The budget is developed from the enforceable obligations listed on the recognized obligation payment schedules.

CONSENT CALENDAR

CC 1. Waive further reading of any proposed ordinances. (This permits reading the title only in lieu of reciting the entire text.)

CC 2. Approve the Check and Wire Registers for December 9, 2012 through January 5, 2013 in the amount of $724,649.58.

At each regular City Council Meeting, the City Council is presented with the financial claims (invoices) against the City for purchase of materials, supplies, services, and capital projects for checks and wires issued the prior two to three weeks. This process provides the City Council the opportunity to review the expenses of the City. The justifying backup information for each expenditure is available in the Finance Department.

CC 3. Accept and approve the December 2012, Monthly Report of Investments as submitted.

Each month, the Finance Department prepares a report listing the investments for all separate entities under the jurisdiction of the City as identified in the City's Comprehensive Annual Financial Report. These component units include: the City of Lancaster and the Lancaster Housing Authority.

CC 4. Approve the transfer of funds for checks issued by the City for individual items less than fifteen dollars ($15) which have remained unclaimed for the period of one year.

California Government Code Sections 50050-50057 establish the rights and procedures related to unclaimed checks issued by local agencies and City Administrative Policy 200-08 stipulates the proper accounting and disposition procedures for these unclaimed checks. The City is permitted to seize any individual items of less than fifteen dollars ($15.00) which remain unclaimed in the treasury or in the official custody of the City for the period of one year without the necessity of publication of a notice in a newspaper.

With Council approval, staff will transfer fifty-two (52) uncashed checks dated at least one year later than January 1, 2012, totaling $330.38 to the City's General Fund Revenue Account.

CC 5. Approve a one-year agreement extension for Carl Warren & Company as the City's Third Party Administrator for liability claims and authorize the City Manager to execute said agreement.

The City of Lancaster entered into a professional services agreement with Carl Warren & Company to provide for administration of liability claims and suits received from individuals who believe the City has responsibility for damage to property or persons. Carl Warren & Company administers claims for more than 175 cities and more than 350 public entities. They are the claims administrators for approximately 25% of the public entities in California. Carl Warren & Company manages claims from their inception to final resolution either at the claims or litigation level.

CC 6. Approve and accept an amendment to the Subdivision Undertaking Agreement submitted by Lancaster Spectrum, LLC ("Subdivider"), for Parcel Map No. 061937, located on the southwest corner of Avenue J-8 and 20th Street West, extending the date of completion to March 1, 2014.

On February 26, 2007, the City and Subdivider entered into a Subdivision Undertaking Agreement to complete the required improvements for Parcel Map No. 061937. The agreement expired February 26, 2009. On January 11, 2013, the City Engineer received a letter from the Subdivider requesting an extension. Staff recommends that Council approve an amendment to the existing Subdivision Undertaking Agreement submitted by Lancaster Spectrum, LLC for Parcel Map No. 061937, extending the completion date to March 1, 2014.

NEW BUSINESS

NB 1. Admission fees for the Museum of Art and History (MOAH)

Recommendation:

Adopt Resolution No. 13-05, amending Resolution No. 12-20 by eliminating admission fees for the Museum of Art and History (MOAH) and rather implementing a suggested donation for visitors in lieu of established fees; appropriate $3,400 to Account No. 101-4644-603 from fund balance for annual direct assessments that do not qualify for exemption.

By submitting a Free Public Library or Free Museum Claim form to the County of Los Angeles Office of the Assessor, the City will receive an exemption to most of the property tax liability associated with the property. By eliminating the fixed admission fees for all visitors and implementing the suggested donation, the City can realize a net savings of approximately $41,000 per year. The City will also apply to receive credit or reimbursement for past annual and supplementary (adjustment due to improvements) which may exceed $60,000.

A benefit of free admission will be an increased attendance at the MOAH, making it more accessible to children, seniors, and citizens on fixed income. The exposure to the world class exhibits, exhibitions, lectures, and interactive programs will be a benefit to both the region's citizens and the community.

Recommendation:

Introduce Ordinance No. 986, restating and amending Chapter 2.34 of the Lancaster Municipal Code relating to the Architectural and Design Planning Commission, Chapter 2.30 of the Lancaster Municipal Code relating to the Criminal Justice Commission and Section 2.04.080 of the Lancaster Municipal Code relating to the position of Deputy Mayor.

As a practical matter, sunset provisions for discretionary and/or advisory commissions and positions created by a legislative body such as a City Council are unnecessary as the commissions or positions exist at the pleasure of the legislative body and can be revised or disbanded at any time by a majority of the legislative body. Therefore it is in the public interest and welfare to restate Chapter 2.34 (originally added by Ordinance No. 902), Chapter 2.30 (originally added by Ordinance No. 904) and Section 2.04.080 (originally added by Ordinance No. 944), to remove sunset provisions for the City's Architectural and Design Planning Commission, Criminal Justice Commission, and the position of Deputy Mayor.
