PUBLIC BUSINESS FROM THE FLOOR - AGENDIZED ITEMS
Any person who would like to address the City Council, Successor Agency, and Power/Financing Authorities on any agendized item is requested to complete a speaker card for the City Clerk/Agency/Authority Secretary and identify the agenda item you would like to discuss. Each person will be given an opportunity to address the Legislative Body at the time such item is discussed. Speaker cards are available at the rear of the Council Chambers and your speaker card must be filled out prior to the agenda item being called. We respectfully request that you fill the cards out completely and print as clearly as possible. Following this procedure will allow for a smooth and timely process for the meeting and we appreciate your cooperation. Individual speakers are limited to three (3) minutes each.

At each regular City Council Meeting, the City Council is presented with the financial claims (invoices) against the City for purchase of materials, supplies, services, and capital projects for checks and Automated Clearing House (ACH) payments issued the prior two to three weeks. This process provides the City Council the opportunity to review the expenses of the City. The justifying backup information for each expenditure is available in the Finance Department.
CC 3.
Adopt Ordinance No. 1013, amending Title 5 of the Lancaster Municipal Code by adding a new Section 5.04.055, relating to business licenses
and the establishment of operational requirements for certain types of businesses.

Ordinance 1013 provides that no person may purchase individual container cans or bottles of beer, with certain allowances for combining several individual containers into a "six-pack;" malt beverage products in any quantity less than six, or manufacturer's pre-packaged four-pack; wine in smaller than 750 milliliter containers; wine coolers in less than pre-packaged multi-quantities; and distilled spirits in less than 350 milliliter containers. Ordinance 1013 also exempts certain types of alcoholic beverage establishments that allow the purchase of beverages for off-site consumption; these include establishments containing public space of 10,000 square feet or larger, and those that hold a large brewery, brew pub/micro-brewery and/or winery license from the California Department of Alcoholic Beverage Control.

Proposed Fiscal Year 2016/2017 and 2017/2018 Budget and Five-Year Capital Improvement Program and Adjustment to Master Fee Schedule

Recommendation:
Conduct the Public Hearing and direct staff to schedule (a) the budget adoption and (b) adjustment to master fee schedule adoption for June 28, 2016.
The City is required to adopt a budget by July 1 of each year that establishes appropriations and estimated revenues for the coming fiscal year. This year staff is recommending adoption of a biennial budget for fiscal years ending 2017 and 2018. The proposed budget is a culmination of many months of work by the City Council and staff in reviewing priorities and evaluating programs to meet those priorities.

Lancaster Lighting Maintenance District Levy of Annual Assessment for Fiscal Year 2016-2017

Recommendation:
Adopt Resolution No. 16-30, a resolution of the City Council of the City of Lancaster, California, confirming the diagram and assessment and ordering the levying of an assessment in Lancaster Lighting Maintenance District for Fiscal Year 2016-2017.
Lancaster Lighting Maintenance District was formed, including subsequent annexations thereto, for the purpose of financing maintenance operations and installation of public lighting facilities, including but not limited to traffic signals (as defined in § 22525 of the California Code) within the City of Lancaster, and assessing those properties which benefit from this service their proportionate share of the cost. Each year the City Council must, by law, order the preparation of an Engineer's Report describing the existing and proposed maintenance services, and conduct a public hearing to establish and order the amount of assessment for the next fiscal year.

Lancaster Landscape Maintenance District No. 1 Levy of Annual Assessment for Fiscal Year 2016-2017

Recommendation:
Adopt Resolution No. 16-31, a resolution of the City Council of the City of Lancaster, California, confirming the diagram and assessment and ordering the levying of an assessment in Lancaster Landscape Maintenance District No. 1 for Fiscal Year 2016-2017.
Lancaster Landscape Maintenance District No. 1 and Fox Field Industrial Corridor Landscape Maintenance District were formed, including subsequent annexations thereto, for the purpose of providing maintenance services to landscaping and appurtenant improvements for various developments within the City and assessing those properties which benefit from this service. Each year the City Council must, by law, order the preparation of an Engineer's Report describing the existing and proposed maintenance services, and conduct a public hearing to establish and order the amount of assessment for the next fiscal year.

Lancaster Drainage Benefit Assessment District and Levy of Annual Assessment for Fiscal Year 2016-2017

Recommendation:
Adopt Resolution No. 16-32, a resolution of the City Council of the City of Lancaster, California, confirming the diagram and assessment and ordering the levying of an assessment in Lancaster Drainage Benefit Assessment District for Fiscal Year 2016-2017.
The City Council previously formed the Lancaster Drainage Benefit Assessment District, including establishment of separate zones, and submitted the proposition to the eligible voters in each respective zone. The majority of voters approved the formation of the District, the separate zones, and the levying of the assessment. The first year's assessment was paid by the developers of the property. Each year, thereafter, the City Council, after public notice and hearing, may determine and impose an annual assessment.

Authorization to Use Biological Impact Fee Funds for the Acquisition of Conservation Property by Wildlands

Recommendation:
Adopt Resolution No. 16-33, authorizing funding for the purchase of 236.91 acres of conservation property by Wildlands and appropriate $1,160,859.00 from the Biological Impact Fee fund balance to Account No. 224-4520-912, Property Acquisitions.
Recently, the development of commercial solar facilities within the City has created both an increased amount of revenue for the biological impact fee and a need to provide mitigation for these facilities. Also, other jurisdictions, such as Kern County and the City of Adelanto, have required their developers of certain projects to provide mitigation through payment of the City of Lancaster's biological impact fee. Such fees are paid to and managed by the City. Staff has, therefore, exercised great care in evaluation of potential acquisition sites to ensure that they meet multiple objectives and demonstrate both effective and efficient use of the available funds, for a regional benefit.
