PUBLIC BUSINESS FROM THE FLOOR - AGENDIZED ITEMS

Any person who would like to address the City Council, Successor Agency, and Power/Financing/Authorities on any agendized item is requested to complete a speaker card for the City Clerk/Agency/Authority Secretary and identify the agenda item you would like to discuss. Each person will be given an opportunity to address the Legislative Body at the time such item is discussed. Speaker cards are available at the rear of the Council Chambers and your speaker card must be filled out prior to the agenda item being called. We respectfully request that you fill the cards out completely and print as clearly as possible. Following this procedure will allow for a smooth and timely process for the meeting and we appreciate your cooperation. Individual speakers are limited to three (3) minutes each.

Consent Calendar items under the Legislative Body may be acted upon with one motion, a second and the vote. If you desire to speak on an item or items on the Consent Calendar, you may fill out one speaker card for the Consent Calendar.  HA CC 1. Approve the Amendment to Agreement for Legal Services ("Amendment") with Stradling Yocca Carlson & Rauth ("SYCR") to expand the scope of City Attorney services to include Bond Counsel services and authorize the City Manager or his designee to execute the amendment.

SYCR has served as bond counsel for the City of Lancaster and has been involved in the various bond issues of both the City and the former Lancaster Redevelopment Agency. Based on their level of expertise staff has determined that an amendment of the existing Agreement to allow SYCR to represent the City in future bond issuances is appropriate.

At each regular City Council Meeting, the City Council is presented with the financial claims (invoices) against the City for purchase of materials, supplies, services, and capital projects for checks and Automated Clearing House (ACH) payments issued the prior two to three weeks. This process provides the City Council the opportunity to review the expenses of the City. The justifying backup information for each expenditure is available in the Finance Department.

CC 3. Accept and approve the August 2014, Monthly Report of Investments as submitted.

Each month, the Finance Department prepares a report listing the investments for all separate entities under the jurisdiction of the City as identified in the City's Comprehensive Annual Financial Report, the City of Lancaster and the Lancaster Housing Authority.

CC 4. Adopt Resolution No. 14-60, approving the amended City Hazard Mitigation Plan for 2013-2018.

The Federal Disaster Mitigation Act of 2000 requires that local governments develop and submit local hazard mitigation plans to the Federal Emergency Management Agency ("FEMA") as a condition of receiving FEMA Hazard Mitigation Grant Program Funds after November 2004. A committee comprised of the City Manager and members of various city departments developed the Hazard Mitigation Plan 2013-2018 (HMP) to serve as the hazard mitigation plan for the City of Lancaster. The Committee received additional feedback from the community during the drafting of the Plan. Subsequently, the City Council approved and adopted the Hazard Mitigation Plan on December 11, 2013 by Resolution No. 13-65. The adopted Hazard Mitigation Plan was submitted to the State of California Office of Emergency Services (CAL-OES) for approval, which was granted on May 15, 2014, subject to required modifications. FEMA granted approval on the HMP on August 6, 2014 contingent upon the adoption of modifications to the Hazard Mitigation Plan by the City of Lancaster City Council as specified in this Resolution

CC 5. Reschedule the November 11, 2014 City Council meeting for Wednesday, November 12, 2014.

 The City Council meeting scheduled to take place in November is November 11, 2014 which is Veterans Day. Staff recommends rescheduling this meeting for November 12, 2014 to allow Council and staff the opportunity to attend events honoring our Veterans.

 NEW BUSINESS

NB 1. Revised Implementation Plan for the Community Choice Aggregation

 Recommendation:

Approve the Revised Implementation Plan for the Community Choice Aggregation and authorize the City Manager or his designee to execute and submit all related documents.

On June 9, 2014, in accordance with California Public Utilities Commission (CPUC) Code Section 366.2 (3), staff submitted the approved Implementation Plan to the CPUC for review and certification. This Revised Implementation Plan reflects updated information regarding the selection process for Energy Supply providers. After an extensive evaluation process, staff has narrowed the list of respondents to a short-list of finalists and has included descriptions of those firms in the Revised Implementation Plan.

NB 2. Award of RFP No. 575-14 - Landscape Maintenance Services for City Parks and the National Soccer Center

Recommendation:

Award a one (1) year contract, with an option of two, 2-year extensions at the City's discretion, to Venco Western, Inc., with an annual cost of $447,840.00, for RFP No. 575-14 for Landscape Maintenance Services for City Parks and the National Soccer Center, and authorize the City Manager, or his designee, to sign all documents. The total agreement period shall not exceed five (5) years.

In February 2014, the City advertised a Request for Proposals for Landscape Maintenance Services. The Scope of Services included all landscape maintenance areas, Lancaster Boulevard, all City Parks, and the National Soccer Center. The base proposal includes routine, day-to-day maintenance and care of all landscaped areas. At the May 27, 2014 meeting, City Council approved an award for the Landscape Maintenance Areas portion of the proposal to Venco Western, Inc. for $790,662.60. Staff is now recommending a contract for the City Parks and Soccer Center be awarded to Venco Western, Inc. in the amount of $447,840.00.
