PUBLIC BUSINESS FROM THE FLOOR - AGENDIZED ITEMS

Any person who would like to address the City Council, Successor Agency, and Power/Financing/Housing Authorities on any agendized item is requested to complete a speaker card for the City Clerk/Agency/Authority Secretary and identify the agenda item you would like to discuss. Each person will be given an opportunity to address the Legislative Body at the time such item is discussed. Speaker cards are available at the rear of the Council Chambers and your speaker card must be filled out prior to the agenda item being called. We respectfully request that you fill the cards out completely and print as clearly as possible. Following this procedure will allow for a smooth and timely process for the meeting and we appreciate your cooperation. Individual speakers are limited to three (3) minutes each.

HM 1. Approve the Housing Authority Regular Meeting minutes of September 10, 2013.

CONSENT CALENDAR

HA CC 1. Amend and assign the lease approved by the Lancaster Housing Authority on May 14, 2013 clarifying the date and process for rent collection, providing certain indemnity to the City and acknowledging US Topco's exercise of its right to assign the lease to its affiliate, Ever CT Solar Farms, LLC.

On May 14, 2013, the Lancaster Housing Authority approved a ground lease between the Lancaster Housing Authority and US Topco Energy, Inc. (Topco), to work cooperatively to design and construct a 3-megawatt photovoltaic solar generation facility on approximately sixteen (16.5) acres of land near the old fairgrounds, referencing APN 3176-005-914 located at East of Division St. South of Avenue H-8.

CC 2. Approve the Check and Wire Registers for September 22, 2013 through October 5, 2013 in the amount of $4,335,528.71.

At each regular City Council Meeting, the City Council is presented with the financial claims (invoices) against the City for purchase of materials, supplies, services, and capital projects for checks and Automated Clearing House (ACH) payments issued the prior two to three weeks. This process provides the City Council the opportunity to review the expenses of the City. The justifying backup information for each expenditure is available in the Finance Department.

CC 3. Accept and approve the September 2013, Monthly Report of Investments as submitted.

Each month, the Finance Department prepares a report listing the investments for all separate entities under the jurisdiction of the City as identified in the City's Comprehensive Annual Financial Report, the City of Lancaster and the Lancaster Housing Authority.

CC 4. Approve and accept the developer installed interior street trees for maintenance by the City for Tract No. 060154 Phase 1, located on the southeast corner of Avenue J and 30th Street East; Owner: Trimark Pacific Lancaster 139, LLC; and Phase 2, located on the southeast corner of Avenue J and 30 th Street East; Owner: KB Home Coastal Inc.

The interior street trees have been installed by the developer according to the approved plans and specifications. The work has been inspected and found to be satisfactory to the Director of Public Works.

CC 5. Approve and accept for maintenance the landscape improvements for the Landscape Maintenance District No. 1, Annexation No. 347, Tract No. 061206, located on the southeast corner of Avenue J and 35th Street East; Owner: KB Coastal, Inc. Appropriate $10,269.00 from the first year's maintenance cost that has been paid by the developer to cover the remaining nine (9) months of the fiscal year into the Landscape Maintenance Operating Account No. 482-4747-402.

The landscaping improvements for this tract have been installed by the developer, according to the approved plans and specifications. The improvements have been completed to the satisfaction of the Director of Public Works.

The water system on this project has been constructed and completed to the satisfaction of the local water purveyor, Los Angeles County Waterworks District No. 40, Antelope Valley, and is/are constructed according to the approved plans and specifications. Additionally, the work has been inspected and found to be satisfactory to the Director of Public Works.

CC 8. Award Public Works Construction Project No. 12-005, Bridge Rehabilitation, to The Truesdell Corporation of California, Inc. of Tempe, Arizona, in the amount of $574,574.00, to repair three bridges throughout the City and authorize the City Manager, or his designee, to sign all documents. This contract is awarded to the lowest responsible bidder per California Public Code Section 22038 (b).

The project involves repairs to the Avenue H Bridge at Amargosa Creek, Avenue H Bridge over Sierra Highway and the Avenue L Bridge over Sierra Highway. Repairs include bridge abutment, handrail, sidewalk and various deck repairs, as well as the application of Methacrylate as a sealant. The Truesdell Corporation of California, Inc. is located in Tempe, Arizona. However, to comply with the Lancaster Local Hiring Ordinance No. 977, the contractor will hire a local subcontractor, ANM Construction and Engineering of Lancaster, and will conduct a job fair to recruit local residents to supplement their own workforce.

PUBLIC HEARING

PH 1. Update to the Lancaster General Plan Housing Element to address housing needs for planning period October 15, 2013, to October 15, 2021 (5th cycle)

Recommendation:

Adopt Resolution No. 13-56, adopting the update to the Housing Element of the City's General Plan.

The Housing Element is the state-mandated General Plan element that addresses how the City will strive to achieve its share of regional housing need within the assigned planning period. The previous Housing Element, for planning period 2006 to 2014 (4th cycle), was adopted by the City of Lancaster on May 22, 2012, but did not achieve certification with HCD.

In order to meet the statutory submittal deadline of October 2013, the City has prepared the 2014 to 2021 (5th cycle) Housing Element for review and adoption. On June 4, 2013, the City submitted the draft Housing Element to HCD for their review, and received comments back on August 5, 2013. On September 16, 2013, the Planning Commission adopted Resolution No. 13-14, recommending approval of the Housing Element Update.

NEW BUSINESS

NB 1. Visitor's Bureau of Lancaster (Destination Lancaster) Bylaws

Recommendation:

Approve proposed amendments to the Visitor's Bureau of Lancaster (Destination Lancaster) Bylaws.

The Visitor's Bureau of Lancaster, more commonly known as Destination Lancaster, is a partnership between the City, Antelope Valley Fair and the Lancaster Tourism Business Improvement District (LTBID). The organization's primary function is to promote the area's attractions and amenities while increasing tourism activity and hotel occupancy. On October 14, 2013, the Destination Lancaster Board of Directors met and approved amendments to their bylaws which would allow a representative from the Lancaster Chamber of Commerce to serve on the board. Per the bylaws, any amendments must be first approved by the Destination Lancaster Board of Directors then approved by the City Council and the Antelope Valley Fair Board. By approving this item, the City Council would be confirming the recommended bylaw amendments made by Destination Lancaster.

NB 2. Proposed Visitor's Bureau of Lancaster (Destination Lancaster) Partnership

Recommendation:

Establish partnership with Visitor's Bureau of Lancaster (Destination Lancaster) to create a new national high school film festival in Lancaster and authorize the City Manager, or his designee, to execute all documents related thereto; appropriate $400,000 (not to exceed) to Account No. 106-4540-251 and increase estimated revenues (not to exceed) in Account No. 106-3235-100 by the same amount.

Destination Lancaster is a partnership between the City of Lancaster, Antelope Valley Fair and Lancaster Tourism Business Improvement District (LTBID), which is comprised of the top seven hotels in Lancaster. The organization's primary function is to promote the area's attractions and amenities while increasing tourism activity and hotel occupancy in Lancaster. Along with marketing existing events and local attractions, Destination Lancaster is also seeking to form new partnerships to create events that would attract visitors from outside our region. Destination Lancaster has been brainstorming event ideas and feels that it has come up with a unique opportunity to bring visitors to Lancaster.

Destination Lancaster is seeking to establish a partnership with the City of Lancaster and the Lancaster Community Services Foundation, to host a national high school film festival in Lancaster. Destination Lancaster, and its event coordinator, would be responsible for marketing the event to high school districts across the United States. Each school district would host its own local film festival and then compete nationally at the high school film festival hosted in Lancaster. One of the key advantages for participating students will be the opportunity to earn college scholarships to further their education in film and media arts. Therefore, Destination Lancaster is seeking a partnership with the Lancaster Community Services Foundation to allow sponsorships that support this program to be tax deductible.

NB 3. General Municipal Election - April 8, 2014

Recommendations:

A. Adopt Resolution No. 13-57, calling and giving notice of the holding of a General Municipal Election to be held on Tuesday, April 8, 2014, for the election of certain officers as required by the provisions of the California Election Code.

B. Adopt Resolution No. 13-58, requesting the Board of Supervisors of the County of Los Angeles to render specified services to the City related to the conduct of a General Municipal Election to be held on Tuesday, April 8, 2014.

C. Adopt Resolution No. 13-59, adopting regulations for candidates for elective office, pertaining to filing fees and candidate statements submitted to the voters at an election to be held on Tuesday, April 8, 2014.

D. Adopt Resolution No. 13-60, providing for the conduct of a special runoff election for elective offices in the event of a tie vote at the General Municipal Election to be held on Tuesday, April 8, 2014.

During odd numbered years, the City Council adopts the necessary resolutions to proceed with the General Municipal Election in April of even-numbered years. The resolutions referenced, fulfill certain legal requirements to conduct the General Municipal Election; requesting information and supplies from the County of Los Angeles; guidelines and costs associated with candidate statements; provisions to conduct a special runoff election to resolve a tie vote if necessary.

Pursuant to Election Code 1301, the General Municipal Election of the City of Lancaster will be held on Tuesday, April 8, 2014, for the purpose of filling two Council Member seats for a term of four years.
